about my good friend, senator jeff bingaman. i think most of the people on his committee feel that he's a good friend. he's been a good friend and mentor to me here in the senate in the years that i've been here, and then also when i arrived in the house we worked with each other. he's been a very good public servant for new mexico and for the united states. and he truly can wear that united states senator proudly. my dad always used to remind me, he used to say -- he said don't forget. you go to represent new mexico, but he says you're a united states senator. and jeff bingaman has worn that title, i think, very, very proudly. jeff is a rare combination of character: brilliant and humble. for jeff, it's about the work. not about his own ego, not about a monument to himself. for three decades in the u.s. senate, he has been making a difference for the american people and for our home state of new mexico. public service is a noble profession when it isn't swamped by money and when it isn't held hostage to partisanship, and jeff is the best example i know of of nobility and politics. by

the gun culture that we are. jeff toobin is cnn legal analyst and christian am pan pour is also here, abc's global affairs anchor. this is rooted in the second amendment, jeff. you say it will be determined as much by politics as by law. is gun culture driving politics, politics driving gn culture? does it change? does the second amendment change from here? >> it sure does. the second amendment itself has not changed more than 200 years. but the interpretation of the second amendment has changed dramatically. for more than 100 years, the interpretation was that state militias, that mysterious first clause, they were the only ones who had the right to bear and keep arms. in 2008 the supreme court of the united states said individuals have a right to keep and bear arms. they were talking about handguns in the home. how expansive that right is remains somewhat murky at this point. the idea that you have a constitutional right to bear arms is a legitimate one for better or worse now. that's something that politicians will have to take into consideration as they decide what to do. >> you've po

'm going to take a few minutes today to honor my colleague, the senior senator from new mexico, jeff bingaman, as he retires from a long career of service to our country. for 30 years, senator bingaman has been a dedicated representative of the people of new mexico, but for those -- for 26 of those years, he was a junior senior from new mexico. the only person that i know of that was a junior senator longer than senator bingaman was fritz hollings. he was a junior senator for many, many decades to strom thurmond. but 26 years here in the senate still makes you a fairly senior member. jeff served alongside senator pete domenici, the longest serving senator in new mexico's history, until in 2009 he was the most senior junior senator. still, mr. president, jeff bingaman has never been one to get hung up on titles or credits. if there were ever the conscience of this body, it's jeff bingaman, a man who has been called by others, including by ron dorgan, a -- including byron dorgan, a workhorse. that's really true. for three decades, he has quietly and with dignity fought for the people o

. that is one of two binding constraints on our economy. >> eliot: before jeff i give him his moment, the reason i disagree is there are trillions of dollars of capital signature on the sidelines not being allocated and not being allocated for a host of reasons primarily a demand crisis and the government given the deficit, spends it. in consumption and its own investment, that seems to me to be the trigger we need to get the economy going. jeff, tell me why you disagree with me or ed. >> i do agree with you eliot. the proof of the pudding is the fact that we did cut tax rates on the rich in the early 2000s under president bush. they're the job creators, the investors, we got a bad economic recovery in expansion. virtually no job creation in that period. the reason is by in large what you're talking about. cutting tax on the rich is not the way to get growth. especially when taxes are already low. the way to get growth now is that we need more demand stimulus and the real danger is all this talk about cutting govern

to bring these jobs back. >> what do you think about jeff immelt's article where he says i'm bringing jobs back to america makes more economic sense. >> he was bringing jobs back to america. i wasn't prepared for this quiz this morning. i can tell you from memory, he brought a bunch of jobs back in lexington, kentucky. >> he is stoned. >> get lexington, kentucky out. >> do you feel like we do? we're going to kick out with frampton after he's done with this answer. >> he brought back a bunch of jobs at lexington, kentucky but at much lower wages. >> what kind? >> it was appliance jobs. >> they have the huge apply hans city down there and all these massive buildings and their own zip code and one building after another closed down. he's starting up one assembly line after another. are they going to get paid $30 an hour? no. >> here's the point. how do you have a ro best recovery when you have wage compression, people who made $30 an hour making $14 an hour. how do you grow an economy like that. >> the point is do we want these jobs building in germany or alabama. want them in lexington, kent

. senator jeff merkley, a democrat from oregon is trying to change that. he's got a proposal to force talking filibusters in the senate. it wouldn't change what i think is a central part in the senate, the 60-vote super majority, but it would make the filibuster into something that the minority had to put some effort into using. you have to want it. now, so i want to be clear on merkley's proposal. if it passed, the minority could still filibuster anything they wanted. they couldn't subject almost everything to the same 60-society challenge we have now. all they would have to do is talk. tell the american people why. and they probably wouldn't even have to do that that much, because the majority can't just let them talk all the time, they have to let them get stuff done. but even that modest reform is too much for many senators. "the huffington post" reports that a bipartisan group of lawmakers led by herman cain and levin are proposing a counter proposal that does even less. it would eliminate some redundant opportunities to filibuster. give quicker consideration to some nominations,

consideration, the main way to change the rules comes from oregon democrat jeff merkley. if you want to filibuster, you can't say 60 vote rule, too bad. can't vote on that. you actually have to go down and hold the floor and talk and talk and talk and talk all night and for days and for weeks. you need to work for it. there is merit to this idea. it would make filibusters harder on the minority. it would make them more transparent to the public. it would make them less likely on popular bills, but it wouldn't reverse the transformation of the senate into a place where 60 votes required to get anything done. so there is a proposal that personally i like better. frankly, it's kind of an ingenious proposal. it recognizes that there is general value in protecting the minority's right to be heard. but in order to protect that right, you don't need to make every vote a 60-vote supermajority. this proposal would in one fell swoop end the 60-vote senate, but it would preserve the interests of lengthy debate. the idea doesn't come from outside group or some young radical. it comes from a long

. jeff, first to you, once the supreme court makes that final decision in the spring, maybe by june at the end of the term, we will know whether or not same sex marriage will be legal, not only in those states like new york state or maryland or iowa where it is legal, but throughout the united states. >> it is a possibility, there are limited possibilities. the court specifically took nose in this case, whether the question of whether the people defending the law in california even have the right to be in court. do they have standing. they could simply rule that the people defending the law don't have standing. that wouldn't even deal with the issue of the constitutionality of same sex marriage. that would be a procedural ruling that would allow the court to duck the issue of is there a constitutional right for gay people to get married. so it's a possility that all 50 states could be ordered to have same sex marriage, but it's also a possibility that the court could duck that issue all together. >> obviously we have to wait to see what the nine justices decide. gloria, you've done

in the senate race? you have jeff flake, a longtime incumbent who has a track record, an interesting truckload on the immigration issue. talk about the way latinos voted in there and the way immigration played. >> you. well, to answer your question why did flake when, it really boils down to name recognition. flake as you indicated, is a well-known name in arizona politics. serving sense, you know, a decade, and the feminine goes way back. his heritage goes way back to the pioneers. that's another thing, factor to keep in mind just the level of enthusiasm among mormon voters were voting for jeff flake but also get mitt romney on the ballot, a mormon candidate. to get high levels of enthusiasm among mormon, the mormon electorate to vote for the two candidates, and that was a significant hurdle for carmona, and obama's campaign to overcome in arizona. >> let's delve into that really briefly because it seems like there is, it seems like there's a potential path for victory for republicans that doesn't necessarily involve latino voters if they can find other ways to tap in and expand their bases.
